Terms and Conditions
About
In these terms and Conditions “we” and “us”
means Trolley Buddy Pty Ltd ABN 62140036424, PO Box 4500,
Elanora, Qld, 4221, Australia and “you” means
you the customer. These terms and conditions together with
you Order constitute the entire contract between us and you
for the supply of products. The contract cannot be changed
unless we agree to change it in writing or email.
Legal Capacity to Transact
You must be over the age of eighteen (18) to place orders
with Trolley Buddy Pty Ltd via their online payment section.
By accepting these terms and conditions you are acknowledging
that you are over the age of 18 (eighteen) years of age. Should
Trolley Buddy Pty Ltd suffer any damage or losses as a result
of a transaction made by a minor, Trolley Buddy Pty Ltd reserves
the right to seek compensation for such losses from the parents
or guardians of the minor who caused orders to be placed with
Trolley Buddy Pty Ltd.
Online Ordering
You may place an order by filling out the order form on the
Trolley Buddy website and clicking the “submit now”
button. By placing an order you make an offer to us for the
purchase of goods you have selected based on these terms and
conditions. We will notify you that your order is being processed
by sending you an Order confirmation and tax invoice via email,
however we do not formally accept your offer until your orders
has passed our internal validation procedures for verifying
the bona fides of each order placed, for the purpose of preventing
credit card or payment fraud. Trolley Buddy Pty Ltd reserves
the right to refuse service or cancel orders at their sole
discretion. If for any reason we cannot fulfil your order,
we will notify you by email. If payment has been made and
the order is unable to be fulfilled, we will advise you in
writing and offer you a full refund or discuss with you alternative
arrangements.
Payment Methods and Processing
Trolley Buddy Pty Ltd accepts payment via cheque, Visa, Mastercard,
Paypal and Money Order.
Payment processing will only begin after we received all the
required information to begin processing.
Orders placed on a weekend will not begin payment processing
until the next business day.
Business days are Monday through Friday excluding Public holidays.
We process credit card and PayPal payments after you click
the “Submit My Order” button.
For Credit card and PayPal payments we will email a tax invoice
to you with your order confirmation. Your tax invoice is your
proof of purchase.
Please be advised that only credit cards issued in Australia
are acceptable.
Debit cards and cheque cards may have daily spending limits
that may delay the processing of your order.
GST
All Trolley Buddy purchases are inclusive of GST.
Prices
Trolley Buddy prices listed on the products page of the website
are current, however Trolley Buddy Pty Ltd reserves the right
to change prices at anytime in accordance with other increases
in the supply chain.
Product
Delivery
Delivery time for products ordered online can take up to 10
working days from the date payment is received. Trolley Buddy
Pty Ltd aims to have all orders dispatched within 3 working
days, however occasionally circumstances beyond our control
may increase delivery time. If you have not received your
order within 10 working days of original purchase date, please
contact us via email or phone.
Unless otherwise agreed by us, we will deliver your products
to the address indicated on your order confirmation form.
If no-one is available to take delivery of your products,
our carrier (Australia Post) will leave a card so you can
pick-up your Product from you local Post Office.
We will use our reasonable efforts to deliver your Products
to you within the estimated delivery time indicated on your
order confirmation form, however, we do not guarantee that
we will deliver within this time frame.
Title and risk of loss to all products will pass to you on
delivery.
Refund Policy
If you change your mind about your product purchase you may
return it within 14days for a full refund (excluding postage
and handling costs). All delivery costs associated with the
return will be your responsibility.
If the product is faulty, send us back the faulty item and
we will replace it. You must pay additional postage and handling
costs.

Our Liability
We will not be liable for any loss of income, loss of profits,
loss of contracts or for any indirect or consequential loss
or damage of any kind whatsoever arising and whether caused
by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any Product supplied to
you whether in contract, tort (including negligence) or otherwise
shall in no circumstances exceed the amount payable by you
to us in respect of the products in question.
Trolley Buddy Pty Ltd reserves the right to change the terms
and conditions of purchases of products at any time.
Force Majeure
Trolley Buddy Pty Ltd shall not be liable for any delay in
performing any of its obligations under these terms and conditions
if such delay is caused by circumstances beyond the control
of Trolley Buddy and Trolley Buddy Pty Ltd shall be entitled
to a reasonable extension of time for the performance of such
obligations.
